Where I live, it is a zoning requirement to put the finished side of the fence facing out. This is a common zoning requirement.

Gee, I thought that was just a common courtesy. In fact I mentioned that to the neighbors before they put it in. They told me that if I were interested in going in on it with them, we could get a double faced fence. I said, of course, that I had no interest in putting up any fence, rather surprised that they would even say that!?. Thanks for the heads up. I'll check on the zoning requirement. I don't want to start a war about it but I would like to find out.

Dirty Toes, Not that I want you to start a war BUT by law the finished side should face you. Just by them saying to you "if you want to go in half" tells me that they also knew this befor they put the fence up. I only found out about this today as a new neighbor just moved in by me and also wants to put a fence up. Now there are 2 sides. If the nicer side faces you then you are going to loose space. As I mentioned if the posts are facing you then you are gaining space NOT to mention "extra" hanging space for flowers. I would mention that you just found out that the law states that the nicer side should face you and that due to the post side being on "your" side, I'm sure you won't mind me drilling some holes and hanging some baskets to the posts . . LOL. To top off the plain posts, I would cap them. They have matching wooden caps at Home Depot. I doubt they are going to want tear down their fence and re-do the posts. I get kinda heated up over fencing issues as you might have noticed. Even though I have a fence (it was here when I moved in) anytime I see my next door neighbor (fenceless) they always comment on how upset they were when the fence went up . . how things don't grow like they use to . . . etc . . I'm sorry . . . I like the fence. It gives me security and I feel more private with it. Anyway, I hope things turn out well for you.

I like my fence too, though I also like dogs and only put up a fence for that reason. I put up a two sided fence, yes more money but hey. I covered most of my fence with vine plants. By the way along with the nice side facing the neighbors law the same neighbor also has rights and is responsible for that side of the fence. He can paint it, drill it or whatever as long as he does not damage it.

Just for curiosity sake I'd like to know if the good side out law still applies when the neighbors put the fence completely on their own property, not on the common boundary? Kars, are you saying that I can paint or drill the fence? I imagine this would not apply since the fence is completely on their own property. An acquaintence told me that here in Park Slope, the owner on the uphill side of the slope is responsible for the common fence. So, I would have sole responsibility for the downhill fence (which is where the new neighbors live). I suppose that only pertains, again, if the fence is on the shared boundary line. Any Slopers know about this or is this a myth? I'm getting used to the fence and am trying to figure out how to support the budding grape vines on it.

DirtyToes, in my town, you have to put the good side out. It doesnt matter where the fence is.
